By signing up to receive text messages from the Campbell Soup Company and/or a Campbell Soup Company subsidiary (collectively and individually “Campbell”), you expressly consent to receive such text messages and to be bound by these terms and conditions (this “Agreement”).  Campbell reserves the right to make changes to these terms at any time.  Please check back from time to time to ensure you are aware of any updates or changes.

Program Description

Campbell and its service providers may use an automatic dialing system to deliver you text messages.  These text messages are intended to provide you with information about Campbell’s products and services (e.g., recipes, promotions, offers, coupons, events, etc.) (the “Service”).  Once you submit your wireless number to Campbell’s short code, you will receive a text message to your wireless number confirming your consent to receive text messages.  Maximum number of messages per month may vary based on the particular service you request from Campbell, but will not exceed five (5) messages per month for each particular service you request.

Billing/Pricing

Messaging and data rates may apply to your use of the Service, depending on your wireless carrier and plan.  Please contact your wireless carrier for additional information on your plan.

Participating Carriers

The Service is supported by many wireless carriers including AT&T, Sprint/Boost/Virgin; T-Mobile/MetroPCS, Verizon Wireless; CellCom USA; C Spire Wireless; U.S. Cellular; Carolina West Wireless (CWW); Google Voice, amongst others.  Participating carriers may change from time to time.

Disclaimer & Dispute Resolution

The Service is offered on an “as is” basis and may not be available at all times.  Transmission of text messages is dependent on coverage and other services provided by your wireless carrier.  Campbell, its service providers and each of their respective officers, directors, and employees are not responsible and shall not be liable for any losses or injuries of any kind resulting, directly or indirectly, from the Service, including without limitation, from technical failures or delays of any kind.  Campbell reserves the right to stop providing the Service to you at any time in its sole direction.

You waive all rights to trial in any action or proceeding arising out of or related to the Service, including this Agreement.  Any controversy or claim arising out of or relating to the Agreement and/or Service shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association and shall be conducted in the State of New Jersey, County of Camden Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. Class arbitrations and class actions are not permitted and you are giving up the ability to participate in a class action.  This Agreement shall be governed by and construed in accordance with the laws of the State of New Jersey without regard to its conflicts of laws rules.

For any matters which are not subject to arbitration as set forth in this Agreement and/or in connection with the entering of any judgment on an arbitration award in connection with this Agreement and/or the Service, the parties irrevocably submit and consent to the exclusive jurisdiction and venue of the state and federal courts located in or closest to the County of Camden in the State of New Jersey.  The parties agree not to raise the defense of forum non conveniens.
